Acceptance of Terms

By downloading, accessing, or using the Tomo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

Tomo is an AI-powered study companion application that helps users learn through spaced repetition, flashcards, quizzes, and other study tools. The App is provided on an "as is" basis and we reserve the right to modify, suspend, or discontinue any aspect of the App at any time.

User Responsibilities

As a user of Tomo, you agree to:

• Provide accurate information during account creation
• Maintain the security of your account credentials
• Use the App for lawful and educational purposes only
• Not attempt to circumvent any technical measures or copy the App
• Not upload malicious, harmful, or illegal content
• Respect intellectual property rights of others

Account and Security

You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage from your failure to comply with this security obligation.

Subscription Services

Tomo offers optional premium features through subscription ("Tomo Pro"). Subscriptions are processed through Apple's App Store and are subject to Apple's terms and conditions.

• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions through your Apple ID settings
• Free trials revert to the standard subscription if not canceled before trial ends

Content and Intellectual Property

Your Content: You retain ownership of the study materials, notes, and content you create or upload to the App. By using our AI features, you grant us permission to process your content to generate study materials.

Our Content: The App, including its design, features, and AI-generated suggestions, is protected by intellectual property laws. You may not copy, modify, or distribute the App without permission.

Disclaimers and Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the App will be uninterrupted, secure, or error-free. AI-generated content may not always be accurate and should be verified by the user.

Limitation of Liability

To the fullest extent permitted by law, Tomo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or educational progress, arising from your use of the App.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease.

Privacy

Your use of the App is also governed by our Privacy Policy, which can be found at tomo.app/privacy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the service provider is established. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Changes to Terms

We may modify these Terms at any time. Changes will be posted within the App and on this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
